It seems there are also new legislations in the works for mystery shoppers and some states have already had it passed. Mystery shoppers are subcontractors, which means at the end of the year the taxes you have to pay on your earnings you do with your taxes. Now new legislation is looking to have companies have shoppers sign a contract and withhold a percentage of your earnings and submit it to the IRS for you.
This new legislation could also mean issues for mystery shoppers, it could take away the right for mystery shoppers to be independent contractors, which is what mystery shoppers are. They work for themselves but are contracted by companies to do the jobs. Right now section 530 of the Revenue Act of 1978 allows and provides protection for independent contractors however changes to this could cause problems for mystery shoppers and companies.
